Customer Terms

  • To make your shopping experience more convenient, Aspire Gallery (Aspire) offers Customers (You) the following layby terms for the purchase of Artwork:

    1.1.       An initial deposit of 30% of the total purchase price of the Artwork is required to be paid to Aspire to layby the Artwork (Initial Deposit).

    1.2.       Upon receipt of the Initial Deposit, Aspire agrees to keep the Artwork on layby for the Customer for twelve (12) weeks (Term).

    1.3.       The Customer agrees to make weekly contributions to the total purchase price of the Artwork on layby (Contributions)

    1.4.       In the event the Customer is unable to proceed with the weekly contributions or is unable to pay the total purchase of the Artwork on layby by the end of the Term, the Customer will have defaulted on the layby.

    1.5.       In the event of default, the Customer agrees to pay a termination fee equal to the Initial Deposit and Contributions.

    1.6.       Upon payment of the total purchase price of the Artwork, ownership of the Artwork vests to the Customer for collection.

  • These Return Terms outlines our guidelines for refunds on Artwork purchases made through Aspire Gallery. Please read these Return Terms carefully before making a purchase.

    1.    Damaged or Defective Artwork

    We take great care in packaging and delivering Artwork to ensure it arrives safe and sound. In the unwanted and unlikely event that your Artwork arrives damaged or defective, please contact us within 72 hours after receiving the Artwork. We may request photographs or other documentation to assess the damage or defect.

    2.    Return Process

    2.1. To initiate a return request, please contact our customer support team via email at info@aspiregallery.com.au. Please provide your order number, contact information, and a detailed explanation of the reason for the return request.

    2.2. We will review your return request and may request additional information or documentation if necessary.

    2.3 Given Artists consign Artwork to Aspire for Exhibitions which have a set term, we do not offer change of mind returns.

    3.    Commissions & Custom:

    Commissions and custom-made Artwork are not likely to be refundable once the artist has begun work, as they are tailored to your specific requests.

    4.    Return of Artwork:

    4.1. If a refund is approved and the Artwork is required to be returned, you will be responsible for securely packaging and returning the Artwork to us. We will provide instructions for the return process.

    4.2. You will be responsible for the return shipping costs, unless the return is due to damage, defect, or misrepresentation on our part.

    5.    Australian Consumer Law:

    5.1. Nothing in these Return Terms excludes, restricts or modifies the rights which you have under the Australian Consumer Law. To the maximum extent permitted by law, our liability to you, whether for breach of these rights or any other condition or warranty implied by legislation or otherwise, is limited, at our option to:

    5.1.1.   in the case of services, the supply of the services again or the payment of the cost of having the services supplied again; or

    5.1.2.   in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired.

    5.2. In no event shall our total liability for any and all damages and causes of action exceed the amount paid by you to Aspire.
